Possession Of Drug Paraphernalia (Health And Safety Code Section 11364)

California Health and Safety Code Section 11364, makes it illegal to possess an opium pipe or any device, contrivance, instrument, or paraphernalia used for unlawfully injecting or smoking a controlled substance.

The prosecutor in your case must prove that (1) you had control of the drug paraphernalia, (2) that you knew of the paraphernalia’s presence and (3) that you knew the item was drug paraphernalia.

Possession of Drug Paraphernalia is charged as a misdemeanor. A skilled attorney can investigate your case and determine if there are defenses that can be used to dismiss your case or to allow you to enroll in a drug diversion program which would take place of any jail time.
