Possession Of A Controlled Substance [Health And Safety Code Sections 11350 And 11377]
You can be charged with Possession of a Controlled Substance under Health and Safety Code Section 11350 if you possess certain types of controlled substances or drugs. It must be proven that (1) you possessed the controlled substance or drug, in that you exercised control over the drug, (2) you knew of the controlled substance or drug’s presence, (3) you knew of the drug’s nature to be of a controlled substance, and (4) the amount or quantity of the substance was enough to be used as a controlled substance.
Some of these controlled substances include (but not limited to) cocaine, heroin, opiates, certain hallucinogenic drugs, methamphetamines and prescription drugs.
Possession of Controlled Substance may be charged as a misdemeanor or a felony.
